Welcome to Nagence, Inc.
Nagence, Inc. (“us”, “we”, or “our”) operates 2Chat (the “Service”).
This Privacy Policy covers our websites (2chat.co, 2chat.com, 2chat.io, 2chat.click, 2chat.store and 2chat.ai) and the 2Chat platform, and explains how we collect, safeguard and disclose information.
Our Terms of Service govern all use of the Service and, together with this Privacy Policy, constitute your agreement with us.
There are two different sets of personal data involved in the Service, and our role is different for each. Which part of this policy applies to you depends on which one you are asking about.
We are the controller of the personal data we process for our own purposes: your account and contact details, your billing records, your support requests, and information we collect from visitors to our websites. Sections 3 to 16 of this policy describe that processing.
We are the processor of the personal data you put into the Service or generate through it while communicating with your own contacts. That includes your contacts' phone numbers and profile details, the content of the calls and messages you exchange with them, recordings, voicemail, transcripts and the metadata describing those communications. For that data you are the controller. What we may do with it is set by you and governed by our Data Processing Agreement, not by this policy.
If you are a customer of one of our users and you want to access, correct or delete your data, or ask why you were contacted, please contact the business that messaged or called you. They decide what data is collected and why. We hold that data on their behalf and will refer your request to them.
SERVICE means the 2chat.co, 2chat.com, 2chat.io, 2chat.click, 2chat.store and 2chat.ai websites and the 2Chat platform, operated by Nagence, Inc.
PERSONAL DATA means data about a living individual who can be identified from those data (or from those and other information either in our possession or likely to come into our possession).
USAGE DATA is data collected automatically either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
COMMUNICATIONS DATA means the content and metadata of calls and messages carried by the Service, as described in section 5.
COOKIES are small files stored on your device (computer or mobile device).
DATA CONTROLLER means a natural or legal person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any personal data are, or are to be, processed.
DATA PROCESSORS (OR SERVICE PROVIDERS) means any natural or legal person who processes the data on behalf of the Data Controller.
DATA SUBJECT is any living individual who is the subject of Personal Data.
THE USER is the individual using our Service.

Usage Data
We may also collect information that your browser sends whenever you visit our Service or when you access the Service by or through a mobile device.
This Usage Data may include information such as your computer's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
When you access the Service with a mobile device, this Usage Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.
Within the platform, Usage Data also includes records of your activity in the application, such as logins, features used, API requests, and counts of calls and messages sent and received on your account.
When you use the Service to communicate, the following passes through our systems. We process it as a processor on your instructions, as described in section 2 and in the Data Processing Agreement.
Communications data can contain anything the parties to a conversation choose to say, which may include sensitive information. You decide what is collected, whether recording and transcription are switched on, and who on your team can see it.
Nagence, Inc. uses the data it collects as controller for the following purposes:
to provide and maintain our Service;
to notify you about changes to our Service;
to allow you to participate in interactive features of our Service when you choose to do so;
to provide customer support;
to gather analysis or valuable information so that we can improve our Service;
to monitor the usage of our Service;
to detect, prevent and address technical issues, fraud, abuse and security incidents;
to verify your identity where a law, regulator or carrier requires it before a phone number can be allocated;
to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;
to provide you with notices about your account and/or subscription, including expiration and renewal notices;
to send you news, special offers and general information about goods, services and events we offer, where you have chosen to receive them and until you opt out;
to comply with legal obligations and to respond to lawful requests from authorities, regulators and carriers;
for any other purpose with your consent.
We do not use the communications data described in section 5 for our own purposes. We do not sell it, we do not use it to build advertising profiles, and we do not use it to train artificial intelligence models.
The Service offers automated transcription, summarization and AI voice agents. Where you enable them, the relevant call audio or message content is processed to produce that output, in some cases by a third party AI provider that you choose to connect. Those providers are listed at https://2chat.co/legal/subprocessors and their own terms govern their processing.
We may review a limited sample of automated output to monitor and evaluate the quality of these features. Contact support@2chat.co if you would like your account excluded from that review.
We retain personal data for as long as we need it for the purposes for which we collected it, unless a law requires otherwise.
Some countries require a communications provider to retain records of calls and messages for a minimum period. Where that applies, we keep the records for as long as the law requires even if you ask us to delete them, and we delete them when that period expires.
Your information, including personal data, may be transferred to and maintained on computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.
The Service may be provided using equipment or facilities located in the European Union, the United Kingdom, the United States and other countries. Calls and messages are necessarily carried through the countries they originate from and terminate in.
Where personal data is transferred out of the European Economic Area, the United Kingdom or Switzerland to a country that has not been the subject of an adequacy decision, we rely on:
the EU-U.S. Data Privacy Framework, the UK Extension to it, or the Swiss-U.S. Data Privacy Framework, where the recipient participates in the relevant framework; or
the Standard Contractual Clauses adopted by the European Commission, together with the UK International Data Transfer Addendum where the transfer is subject to the UK GDPR, in each case with such additional measures as are required in the circumstances.

Nagence, Inc. will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.
We may disclose personal information that we collect, or you provide:
To our service providers and subprocessors, listed at https://2chat.co/legal/subprocessors, who process data on our behalf and are obliged not to use it for any other purpose.
To carriers and channel providers, to the extent necessary to originate, terminate and deliver your calls and messages, and to allocate and maintain your phone numbers. This necessarily includes the numbers involved in a communication.
For law enforcement and regulatory requests, where we are required to do so by law or in response to valid requests by public authorities, and to respond to traceback and abuse inquiries from carriers and channel providers.
In a business transaction, if we or our subsidiaries are involved in a merger, acquisition or asset sale, in which case your personal data may be transferred.
We may also disclose your information to our subsidiaries and affiliates, to fulfil the purpose for which you provide it, to include your company's logo on our website where you have permitted that, for any other purpose disclosed by us when you provide the information, and with your consent in any other case.
The security of your data is important to us, but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal data, we cannot guarantee its absolute security.
The technical and organizational measures we apply are described in Annex 2 of our Data Processing Agreement.
We use cookies and similar technologies (including beacons, tags, scripts and local storage) on our websites.
Strictly necessary. Needed for the site to work, including your language choice, your cookie choice itself, security, load balancing and fraud prevention. These cannot be switched off.
Analytics. Help us understand which pages people read and where they get stuck. Set by Google Analytics, PostHog, Microsoft Clarity and Ahrefs Analytics.
Advertising. Measure which campaigns bring people to the site and allow us to show ads to people who have visited before. Set by Google Ads, Meta, Reddit and Tolt.
How to control them. If you are in the European Economic Area or the United Kingdom, analytics and advertising cookies are not set until you accept them in the cookie banner shown on your first visit. You can change your answer at any time using the “Cookie preferences” link in the footer of any page. Elsewhere, you can control cookies through your browser settings, and through the vendor opt-outs listed in section 15. If you refuse all cookies, some parts of the Service may not work.
Do Not Track. Do Not Track is a preference you can set in your web browser to tell websites that you do not want to be tracked. There is no common industry standard for how a site should respond to it, and we do not currently respond to Do Not Track signals.
Global Privacy Control. We treat a Global Privacy Control (GPC) signal as a valid request to opt out of the sale or sharing of personal information and of targeted advertising. Where we receive a GPC signal from your browser, we do not load advertising cookies for that visit.
We may use third-party service providers to monitor and analyze the use of our Service. These load only where your cookie choice permits, as described in section 12.
Google Analytics
Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualise and personalise the ads of its own advertising network.

PostHog
PostHog is a product analytics service provided by PostHog, Inc., which we run in PostHog's United States region. It records which pages are viewed and which features are used, on both our marketing website and our web application.
PostHog assigns your browser an identifier. When you move from our marketing website (2chat.co) to our web application (app.2chat.io), we pass that identifier across so the same visit is not counted as two separate people. This means activity on the marketing site can be connected to your account once you sign up.

Microsoft Clarity is provided by Microsoft Corporation and records how visitors interact with our pages.

Nagence, Inc. uses remarketing services to advertise on third party websites to you after you have visited our Service. We and our third-party vendors use cookies to inform, optimise and serve ads based on your past visits to our Service. These load only where your cookie choice permits, as described in section 12.
Google Ads
Google Ads remarketing service is provided by Google LLC.

Tolt provides affiliate and referral attribution for our partner program, recording which partner referred a visit.
We may employ third party companies and individuals to facilitate our Service, provide the Service on our behalf, perform Service-related services or assist us in analysing how our Service is used. These third parties have access to your personal data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Payments
We use third-party payment processors. We will not store or collect your full payment card details. That information is provided directly to our payment processors, whose use of your personal information is governed by their privacy policy. These processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council.

Error tracking
Sentry is an error tracking solution provided by Functional Software, Inc. More information is available at https://sentry.io/privacy/.
Development tools

2Chat Google Sheets add-on
Use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

the right to withdraw consent. You also have the right to withdraw your consent at any time where we rely on your consent to process your personal information.
Please note that we may ask you to verify your identity before responding to such requests, and that we may not be able to provide the Service without some necessary data.

CalOPPA requires commercial websites and online services to post a privacy policy stating the information being collected and those individuals with whom it is being shared, and to comply with that policy. According to CalOPPA we agree to the following:
users can visit our site anonymously;
our Privacy Policy link includes the word “Privacy” and can easily be found on the home page of our website;
users will be notified of any privacy policy changes on this Privacy Policy page;
users are able to change their personal information by emailing us at support@2chat.co.

If you are a California resident, you are entitled to learn what data we collect about you, ask to delete your data, and ask us not to sell or share it. To exercise your data protection rights, you can make certain requests and ask us:

You are entitled to ask us to provide you with this information up to two times in a rolling twelve-month period. When you make this request, the information provided may be limited to the personal information we collected about you in the previous 12 months.
To delete your personal information. If you make this request, we will delete the personal information we hold about you as of the date of your request from our records and direct any service providers to do the same. In some cases, deletion may be accomplished through de-identification of the information. If you choose to delete your personal information, you may not be able to use certain functions that require your personal information to operate.
To stop selling your personal information. We do not sell or rent your personal information to any third parties for money. Our use of advertising cookies described in section 15 may constitute “sharing” for cross-context behavioural advertising under California law, and you can opt out of it through the cookie preferences link in the footer or by sending a Global Privacy Control signal, as described in section 13.
If you ask us to delete or stop sharing your data, it may impact your experience with us, and you may not be able to participate in certain programs or membership services which require the usage of your personal information to function. In no circumstances will we discriminate against you for exercising your rights.

Our Service may contain links to other sites that are not operated by us. If you click a third party link, you will be directed to that third party's site. We strongly advise you to review the Privacy Policy of every site you visit.
We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.
Our Service is not intended for use by children under the age of 18 (“Child” or “Children”).
We do not knowingly collect personally identifiable information from Children under 18. If you become aware that a Child has provided us with personal data, please contact us. If we become aware that we have collected personal data from Children without verification of parental consent, we take steps to remove that information from our servers.
We have no direct relationship with the contacts that our customers communicate with through the Service. Our customers are responsible for the data they upload and for the people they contact, and are required by our Terms of Service not to upload data relating to, or use the Service to communicate with, any person under 18 without a lawful basis and any consent applicable law requires.
We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the “last update” date at the top.
Where the change is significant, we will let you know by email and/or a prominent notice on our Service before it becomes effective.
