Acceptable Use Policy

  1. Scope

This Acceptable Use Policy (“Policy”) governs how you and your Users may use the 2Chat service operated by Nagence, Inc. (“Company”, “2Chat”, “we”, “our”, “us”). It forms part of our Terms of Service and is incorporated into them by reference.

We publish this Policy separately from the Terms of Service because the rules in it change when the carriers, channel providers and regulators we depend on change theirs. We may update this Policy at any time by posting the amended version on this page.

Messaging has its own additional rules. See our Messaging Policy, which applies to all SMS, MMS and WhatsApp traffic you send through the Service and is also incorporated into the Terms of Service.


  1. What the Service is for

You may use the Service for making, receiving, recording, transferring, transcribing, summarizing and analyzing calls, and for sending and receiving messages, in each case in the course of a business activity. You may not use the Service for any other purpose.


  1. General restrictions

You and your Users shall not:

  • circumvent or disable any technological feature or security measure implemented in the Service;

  • violate any applicable law or regulation, or any policy published by us or by our carriers and channel providers, including any requirement to obtain consent before transmitting, recording, collecting or monitoring data or communications;

  • infringe the intellectual property, privacy or other proprietary rights of any person;

  • transmit content that is illegal, exploitative, abusive, harmful, unwanted, deceptive, inappropriate or objectionable in the recipient's jurisdiction;

  • stalk, harass, bully or harm another individual, or engage in spamming, phishing or pharming;

  • introduce any virus, worm, trojan horse, time bomb or other code designed to distort, delete, damage or disassemble the Service;

  • send communications on behalf of, or purporting to originate from, 2Chat;

  • license, sublicense, sell, resell, rent, lease, transfer, assign, distribute, time share or otherwise commercially exploit the Service, or make it available to any third party, other than as expressly permitted by the Terms of Service;

  • use the Service to process data on behalf of any third party, other than as expressly permitted by the Terms of Service; or

  • create multiple accounts to circumvent the trial period or any usage allowance.


  1. Voice calling

You and your Users shall not:

  • use the Service for auto-dialing, “predictive” dialing, robocalls or bulk call-in lines, except under a written add-on agreement with us;

  • trunk or forward a 2Chat number to another phone number, private branch exchange (“PBX”) or system capable of handling multiple simultaneous calls;

  • generate artificially inflated traffic, or traffic whose purpose is to earn termination or access revenue rather than to communicate;

  • engage in fraudulent activity to the prejudice of third parties, or use the Service to bypass phone identification systems; or

  • call a number that appears on a do-not-call registry, or on your own internal do-not-call or suppression list, where the applicable rules do not permit the call. Screening your lists is your responsibility, as set out in the Do-not-call and suppression lists section of the Terms of Service; or

  • present a calling number or caller identity that you are not authorized to use, that does not reach you, or that is otherwise misleading.

You will cooperate promptly with any traceback request or any inquiry from a carrier, channel provider, regulator or law enforcement authority relating to traffic sent from your account. We may block, throttle or suspend your traffic while such an inquiry is open.


  1. Emergency services

2Chat numbers cannot be used to call emergency services. See the Emergency Services section of the Terms of Service for the full notice and for the obligations it places on you. You must not represent to any User, customer or third party that a 2Chat number can reach an emergency service.


  1. Call recording and transcription

The Service can record calls and produce transcripts and summaries. Whether to enable these features is your decision.

You and your Users shall not:

  • use the recording feature without first giving any notice, and obtaining any consent, required by applicable law, or without keeping any documentation that applicable law requires you to keep;

  • fail to meet any statutory obligation relating to the recording of a telephone call; or

  • use the recording feature during any period in which credit card, debit card or other payment information is disclosed during the call.

The laws of some jurisdictions give individuals the right not to have calls recorded without the consent of one party or of all parties, and others impose additional conditions such as a transparency notice or internal compliance documentation. We take no responsibility for that consent, notice or documentation. You are solely responsible for compliance with those laws.


  1. Fair use

Where an allowance is described as unlimited, it is provided for ordinary business use by human users. We reserve the right, at any time and at our sole discretion, to:

  • impose limits on your or your Users' usage of the Service;

  • charge you the applicable calling or messaging rate for traffic beyond ordinary business use; and

  • suspend or terminate all or part of the Service.


  1. Account security and usage charges

You are responsible for all use of your login details and API keys, including use by any person who obtains them, and for all charges arising from that use. This includes charges arising from fraudulent traffic to premium rate or high cost destinations.

In the event of loss, theft or compromise of the security or confidentiality of your login details or API keys, or in the event of suspected or actual unauthorized use of your account, you must notify us immediately at support@2chat.co.

We may cap, throttle or suspend traffic that our fraud systems flag. Doing so does not limit your liability for charges already incurred, and we are under no obligation to detect fraudulent use.


  1. Information and verification

You shall provide us with true, accurate and complete information in connection with your access to and use of any 2Chat number, keep that information current, and provide reasonable cooperation with information requests from law enforcement, regulators, carriers and channel providers.

To comply with applicable laws and regulations, including fraud prevention and telecommunications requirements, we may require you to complete an identity verification process. You agree to provide accurate and truthful information when asked. We may suspend or terminate the Service if you fail to complete that process, provide false or misleading information, or if verification cannot be successfully completed.


  1. Enforcement

We reserve the right to implement policies and procedures to monitor, screen, refuse, remove and prevent prohibited use of the Service, but we are under no obligation to take any such action.

If you or your Users breach this Policy, we may immediately suspend or terminate all or part of the Service and the Terms of Service, without penalty or liability to us. You remain liable for any fixed fees incurred in respect of a number or account suspended or terminated under this Policy.


  1. Reporting abuse

To report a breach of this Policy, or traffic you believe originates from the Service, email support@2chat.co with “Acceptable Use” in the subject line.
